These Terms apply when you use SashMark or purchase a SashMark property report or access pass.

SashMark is operated by Joseph Norton, trading as SashMark.

By purchasing from SashMark, you agree to these Terms.

1. What SashMark provides

SashMark provides property information and research tools intended to help home buyers investigate a property before making an offer or progressing with a purchase.

We bring together information from a range of public, official and third party sources and present it in a simpler format.

A SashMark report may include information relating to matters such as property history, previous sales, estimated value, planning, flooding, environment, schools, crime, noise, connectivity and other relevant property or area information.

The information available varies between properties and locations. Not every report will contain every type of information.

2. What SashMark is not

SashMark is an information and research service.

It is not a property survey, structural survey, conveyancing search, environmental search, mortgage valuation or professional valuation.

SashMark does not provide legal, financial, surveying or investment advice.

Any property value shown is an estimate based on the information available to us and should not be treated as a formal valuation or guarantee of the price a property will sell for.

You should use appropriate professional advice and checks when making significant property decisions.

3. Property information

We take reasonable steps to match information to the property being researched and to use appropriate sources.

However, property information can be incomplete, delayed, inaccurate or unavailable.

Much of the information used by SashMark originates from organisations and datasets outside our control. We cannot guarantee that every source is complete, current or error free.

Distances, scores, estimates, classifications and other calculated information may also depend on the accuracy and availability of the underlying data.

A lack of information in a report does not necessarily mean that a particular issue does not exist.

4. SashMark scores and findings

SashMark may use scores, ratings, comparisons and automated calculations to make property information easier to understand.

These are SashMark's interpretation of the available evidence and are provided as research aids rather than professional assessments.

They should be considered alongside the underlying information and any further investigations appropriate to the property.

5. Purchases

The price and contents of your purchase will be shown before payment.

Payments are processed by our payment provider.

We may offer individual reports, time limited access passes or other products.

The exact price, allowance and access period applicable to your purchase are those shown to you when you place the order.

6. Report passes

Where a purchase includes an allowance for multiple property reports, the allowance applies to new properties researched during the stated access period.

Reopening a report already generated for the same property does not normally use another report from your allowance.

Unused report allowances do not roll over beyond the applicable access period unless we expressly state otherwise.

Passes are intended for reasonable personal use by an individual researching properties.

We may prevent automated, abusive, fraudulent, excessive or commercial use of the service.

Expiry of a pass does not by itself remove access to reports already generated under that purchase.

We recommend downloading any report you wish to retain.

7. Report access

Where available, SashMark may allow you to return to reports you have previously purchased or generated.

Access may be associated with information such as your purchase email, browser session or a secure access link.

You are responsible for keeping secure any access link sent to you.

We may make reasonable changes to the way reports are stored, accessed or delivered as the service develops.

8. Immediate digital supply and cancellation

SashMark reports are intended to be generated and supplied shortly after purchase.

Where you ask us to begin supplying digital content or services immediately, you may lose or affect your statutory right to cancel once that content has been supplied or the service has been performed.

We will obtain any consent or acknowledgement required by law before beginning immediate supply.

Nothing in these Terms removes any cancellation or refund right that you are legally entitled to.

9. Problems and refunds

If you purchase a report and we are unable to provide the purchased service because of a fault with SashMark, please contact us.

Depending on the circumstances, we may attempt to correct the problem, regenerate the report or provide an appropriate refund.

The amount or type of information available naturally differs between properties. A report containing less information than another property does not by itself mean the service is faulty.

Your statutory consumer rights are not affected.

10. Availability

We aim to keep SashMark available and operating reliably, but we do not guarantee uninterrupted access.

External data providers, APIs and other services used by SashMark may occasionally become unavailable or change the information they provide.

We may modify, replace, remove or add data sources and features as SashMark develops.

Where reasonable, these changes will not affect rights you have already acquired through a completed purchase.

11. Your use of SashMark

SashMark reports are intended primarily for your own property research.

You must not misuse the service, attempt to gain unauthorised access, systematically extract data, interfere with its operation or reproduce or resell SashMark reports as a commercial service without permission.

12. Liability

Nothing in these Terms limits liability where it would be unlawful for us to do so or affects rights that cannot legally be excluded.

SashMark is not responsible for decisions made solely on the basis of a SashMark report.

We are not responsible for inaccuracies or omissions originating from third party information where we have taken reasonable steps in providing the service.

We are not liable for losses that were not reasonably foreseeable when the contract was entered into.

SashMark is supplied for personal property research rather than business or professional use.

13. Privacy

Personal information is handled in accordance with our Privacy Policy.

Payment card information is handled by our payment provider rather than stored directly by SashMark.

14. Changes to these Terms

We may update these Terms as SashMark and the services we provide change.

The Terms applying to a particular purchase will generally be those in effect when that purchase was made.

15. Governing law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer rights that apply to you.

Cancellation request

If you have a statutory right to cancel that still applies, you can contact us and clearly tell us that you wish to cancel your purchase.

Please include the email address used for the purchase and enough information for us to identify the order.
